By order of May 28, 1998, the application for leave to appeal was held in abeyance pending the decision in Layman v Newkirk Electric Associates, Inc, (Docket No. 105245). On order of the Court, the decision having been issued on July 30, 1998, 458 Mich 494 (1998), the application is again considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.


Cavanagh and Kelly, JJ., would remand the case to the Workers' Compensation Appellate Commission with the direction that it remand the case to the magistrate for further consideration.
